Purchase Terms and Conditions

Introduction
This document shall represent the agreement entered into between FarmaOn, a part of Farmaci Daja 2, registered with the NRC with Commercial Register Number NIPT: K72218008U, and address at Rr. Elbasanit, Pallati Classic Construction, Tirana and the Customer, who shall be any entity making online purchases on www.farmaon.al.
This agreement shall provide the purchase Terms and Conditions (hereinafter referred to as the Terms and Conditions), with rights and obligations for the website users (hereinafter referred to as You, the Customer, the Buyer) and FarmaOn (hereinafter referred to as We, FarmaOn, the Merchant).
FarmaOn shall have the right to change and update the Terms and Conditions at any time. Any changes shall be published on this website and shall enter into effect at the time of publication. They shall in no circumstance have any ex post facto effect.
By placing an online order on the www.farmaon.al website, You agree with all Terms and Conditions. You are responsible for reading and understanding all Terms and Conditions before making any purchases. Should you not agree with the Terms and Conditions, you should not use the services provided on this website.
FarmaOn shall have the right to cancel any orders and deny access for one or more entities when Terms and Conditions are not complied with and for any other reason.

Purchase procedure
To place orders and make online purchases, the Customer must be over 18 years of age, and must have complete legal capacity to act.

Products
The Customer may familiarize themselves with the products on the www.farmaon.al website and get information on their main characteristics. Product quality, use and price and other information is provided for all products available.
FarmaOn cannot guarantee that all information is up to date and free of mistakes.
The pictures posted shall have illustrative purposes only, and may not always display actual product features such as, color, shape, and size, which may not be the same as those published in the text for the given product. FarmaOn shall not be liable for any mistakes or discrepancies in the product illustration.
Should the Buyer notice that the features of the delivered product are not the same as those published on www.farmaon.al, he/she shall have the right to inform FarmaOn and return the product in question.
FarmaOn cannot guarantee the availability of every product posted on the website. Availability shall depend on warehouse stock during the previous business day. In case the ordered product is out of stock, FarmaOn shall undertake to inform the customer as soon as possible by way of any contact information made available by the latter.
FarmaOn may at any time decide to suspend, change or terminate the online posting and sale of products for maintenance, website updates, or any other reason.
FarmaOn reserves the right of ownership over the products delivered until the complete payment of the relevant price has been effectuated by the Customer (transfer of funds into the FarmaOn bank accounts).

Product prices
A price shall be assigned to all products, and said price shall include the VAT for the product. This price shall not include shipping costs. FarmaOn shall have the right to change prices at any time.
In case of print mistakes related to the price or one or more products, FarmaOn shall inform the Customer about the mistake. The Customer shall be free to complete or cancel the purchase.

Shipping costs

Product shipping costs shall be calculated based on the total order amount and location of the Customer. These costs are published on the www.farmaon.al website.
The Customer shall be informed about the product shipping costs during the placement of the order on the FarmaOn website.
The Customer shall agree that he/she is fully informed regarding shipping cost payment, which shall be added to the price of the products ordered.
Order placement
The Customer selects the product(s) using the procedure described on the website and reviews the preliminary order, which shall include data on products, quantity, price, shipping costs and total amount to be paid.
The Customer shall confirm the purchase and must provide accurate and truthful information, which shall be necessary to complete the purchase and deliver the products.
Upon confirmation of purchase, the Customer shall be notified by email, which shall include a confirmation of the purchase and information on the product, amount, price, and order number.
The Customer order shall be considered accepted only after confirmation by FarmaOn.

FarmaOn shall have the right to refuse and not execute Customer orders at any time and for any reason. In any case, FarmaOn shall inform the Customer using one of the contact methods provided by the latter.
FarmaOn shall not be liable for website malfunctioning, delays, or refusal to place orders online, resulting from events which are out of the reasonable FarmaOn control.

Opening an account
FarmaOn enables all website users to open an account on the www.farmaon.al website and sign up with accurate identification and payment methods information (debit/credit card information). When opening an account, Customers provide a username and password, which shall be required to access their account. The Customer shall be solely responsible for keeping their password secret and not disclosing it to third parties.
FarmaOn shall bear no liability if third parties place orders and make purchases in the Customer account using their username and password.

Payment
Upon completing the order, the Customer shall undertake to pay the relevant amount for the products purchased and the shipping costs. The Customer shall select one of the payment methods provided by FarmaOn, which shall be cash payment on delivery, debit/credit card payment, or bank transfer payment.
Should FarmaOn not be able to complete the order or a part thereof, the Customer shall be reimbursed the relevant amount for the missing products and relevant shipping costs.
The information recorded in the FarmaOn system shall serve as evidence of the communication, orders and payments between FarmaOn and the Customer. Confirmation of information by the Customer and provision of the credit card number shall constitute signature and expressed consent for all transactions made on the www.farmaon.al website.
During payment, the Customer is directly connected to the payment server, which is a part of the bank data processing center control system.
The Customer banking information, which shall be protected through encryption, shall not be processed through or stored on FarmaOn electronic systems.
FarmaOn shall bear no liability if the bank card used to make payments on the www.farmaon.al website is stolen or has been declared lost, should the relevant bank authorize payment.

Product Delivery
Product Delivery shall be completed within the timeframes published on this website; within 2 days from the day following order confirmation by FarmaOn for orders within the territory of Albania, and within 7 days for orders within Kosovo. However, these timeframes are provided only for reference and shall depend on the available product stock.
The Customer shall be contacted by the shipper by phone within the abovementioned timeframe, to set a time for the delivery of the order.
Shipping is available in Albania and Kosovo only.
Should delivery require more time than the provided timeframe, FarmaOn shall inform the Customer at the earliest possible. The Customer shall have the right to proceed with the order or to completely or partially cancel it.
FarmaOn shall not be liable for events beyond its reasonable control, such as events of force majeure or events dependent on the shipper, which may lead to delays or failure to deliver orders.
Delivery delays or failures shall not result in the indemnification of the Customer or his/her suppliers.

The Customer shall undertake to take delivery of the order on their own behalf or on behalf of the person named in the order, at the address provided by him/her when the order was made.

Should packaging be damaged during transport, the Customer shall have the right to refuse delivery of damaged products, by providing the refusal reason on the delivery paperwork.
Is singing the delivery paperwork without any comments, and in accepting to take delivery of the order, the Customer shall acknowledge that the products delivered are free of defects or damage.
Should there be any issues related to the delivery of damaged products or products that do not meet the quality or quantity ordered, the Customer shall undertake to inform FarmaOn.
FarmaOn will reship the accurate order within 5 (five) days from being informed as provided above.
Should the product You have orders no longer be available, FarmaOn shall reimburse the purchase amount within 14 (fourteen) days.
Should the shipper not be able to deliver the order because of the Customer, such as in cases of failing to respect the time agreed for delivery, failure to communicate special access conditions, the Customer shall not be reimbursed for shipping costs. The shipment return costs shall also be deducted from the amount reimbursed for the product price.

Order Cancellation

The Customer shall have the right to cancel their order, should FarmaOn fail to meet the delivery times provided in this document, and shall duly inform FarmaOn in this regard.
The request to cancel shall only be considered if order delivery is not completed between the shipment date and the request date.
In these cases of cancellation, the Customer shall be reimbursed their payment within 14 (fourteen) days from the date FarmaOn receives the relevant cancellation request.

Product Returns

The Customer shall have the right to return the product, without providing any reason, within a timeframe of 14 calendar days from taking delivery of the order, pursuant to Article 37 of Law No. 9902, dated 17.04.2008 “On Consumer Protection”.
The product should be returned to the address provided by FarmaOn in the beginning of this document. The returned product should be in its original packaging, undamaged, unused, and should include all accessories and documentation verifying its online purchase.
Products returned in a damaged or used state, with missing parts, or contaminated shall not be accepted by FarmaOn.
The Customer shall be reimbursed the product price. Any return costs shall be borne by the Customer.

Personal data protection
FarmaOn stores and processes customer personal information pursuant to Law 9887, dated 10.03.2008 “On personal data protection”.
The main purpose for personal data processing is to ensure adequate order delivery through the www.farmaon.al website, to improve service quality, and to communicate information related to orders and of interest to customers.
The customer has the right to refuse promotional offer communication by FarmaOn at any time.
FarmaOn stores personal data and these data may be shared with our commercial partners only after the expressed consent of the customer.
Personal data are protected with a username and password protocol that the customer uses for all online purchases. The Customer shall undertakes to keep this password confidential. Should the customer believe or suspect that his/her account is at risk, he/she should inform FarmaOn immediately.
The customer shall have the right to access, correct, and delete his/her personal data, and to refuse the processing of his/her data. The customer may exercise these rights at any time through a request addressed to FarmaOn.
